Italy's Constitutional Court has ruled against recognizing a non-binary gender option in birth certificates, stating that such changes require legislative action.
This decision arose from a case in Bolzano, where a transgender individual sought to change their gender designation from female to 'other.
' The court emphasized that introducing a third gender would necessitate a comprehensive legislative overhaul, affecting various legal areas currently based on a binary system.
However, the court did eliminate the requirement for transgender individuals to obtain judicial approval for surgeries, allowing them to proceed based on medical evaluations alone.
Legal representatives have welcomed this ruling as a step forward, urging the Parliament to address the rights of non-binary individuals and update outdated laws.
