Italy's Autonomy Law Faces Constitutional Hurdle

Published: 2024-11-14

Italy's Constitutional Court has partially accepted a challenge against the differentiated autonomy law for ordinary statute regions, which allows regions to request additional forms of autonomy.

The challenge was brought by the regions of Puglia, Toscana, Sardegna, and Campania, while the government and regions like Lombardia, Piemonte, and Veneto defended the law.

The Court found certain provisions unconstitutional, particularly those affecting the allocation of competencies to regions and the definition of essential service levels (LEP).

These provisions have been annulled, creating gaps that the Parliament must address to ensure the law's functionality.

The Court emphasized the need for regional autonomy to enhance public efficiency and political responsibility, while maintaining national unity and equality.

This decision has sparked varied reactions from regional leaders and national politicians, highlighting the ongoing debate over regional autonomy in Italy.
