Italy Drops Controversial Judicial Gag Rule

Published: 2024-11-30

In a significant move, Italy's Council of Ministers has approved a justice decree that notably excludes a controversial provision aimed at restricting magistrates' freedom of expression.

The provision, which was criticized for potentially punishing judges who did not abstain from cases due to 'grave reasons of convenience,' was seen as a threat to judicial independence.

This decision comes amid tensions with the National Magistrates Association (ANM), which had strongly opposed the measure, arguing it could undermine democratic principles.

Justice Minister Carlo Nordio decided to remove the clause, viewing it as a step towards easing conflicts with the judiciary.

The decree also includes measures on cyber security and other judicial reforms, marking a comprehensive approach to justice system improvements.
